Our Corporate and Commercial team advise on escalation of disputes timetables and work with clients to find points of agreement when business relationships start to break down, in order to find the quickest route to resolution.
Gabrielle Plews’ experience includes:
- Helping the CEO’s of Telcos Three UK and EE Limited find points of agreement during management of the Mobile Broadband Network Limited’s Shareholders Agreement where the cost-sharing previously agreed for the roll-out of the 3G Network was being renegotiated in light of the RAN sites now being selected for EE’s 4G Network roll-out.
- Advising on the Escalation of Disputes timetable in the Shareholders Agreement. Drafting correspondence between the CEOs with OFCOM’s regulatory views being taken into account to resolve disputes and avoid potential litigation, which has allowed Gabrielle to quickly assess and understand the pathway to repairing business relationships.
A potential dispute can often be avoided by asking for legal advice on the current contractual position, or it may need some creative thinking about how to incentivise a re-negotiation or contract change to reflect the unanticipated or difficult-to-foresee consequences of doing business with a key investor, supplier or customer.
These potential disputes are much easier to handle and resolve with the appropriate level of legal advice and support.
