In an article published in the Discrimination Law Association Briefings 732-744, Bindmans Associate Nick Fry examines the above case concerning a surgeon’s claim that he had been discriminated against because of a disability comprising general anxiety disorder and depression. The Employment Appeal Tribunal considered whether the Employment Tribunal had misdirected itself in deciding that the effects of Mr Saad’s condition were neither ‘substantial’ nor ‘long term’, and therefore his condition did not meet the definition of disability under the Equality Act 2010.
