Monika Sobiecki, partner in our Media and Information Law team, has commented in Compliance Week on the new enforcement approach from the Information Commissioner’s Office (ICO) to AI development and usage, which experts say seeks to carve a middle way between the European Union and the United States.
The ICO’s AI and biometrics strategy, launched on 5 June, aims to ensure than organisations developing and deploying AI capable of automated decision-making (ADM) do so lawfully. The ICO will develop a code of practice for organisations doing this, with expectations for using ADM systems. This is a divergence of the UK from the EU, moving in between the EU’s safeguards and the US’s innovation-favouring approach.
Monika says that the divergence between the UK’s regime and the EU puts the adequacy decision that enables the free flow of data between the two markets, in “potential jeopardy.”
